The Magistrate court issues a decision to evacuate the settlers from the first floor of Al-Khayyat building
The Magistrate court issued a decision last Sunday to evacuate the settlers from the first floor of Al-Khayyat building in the neighborhood of Wadi Hilweh in Silwan. The first floor which was taken over by the settlers last September should be handed to the heirs of Shafiq Al-Khayyat. Lawyers Midhat Deebeh, Majed Ighbaryeh and Mohammad Dahleh submitted an appeal to the Magistrate court against the take-over of the first floor of the building in the neighborhood of Wadi Hilweh in Silwan. Lawyer Midhat Deebeh said: “we were able to obtain a decision from the Magistrate court to take back the first floor after four hearing session.” He added: “during the court session, we found out that “Elad Settlement Organization” and “Kendal Financial” which is a property company that was established in “Angola” did not have an address in Israel and were not registered in the Israeli companies. The court asked them to present documents to prove their ownership but they claimed that they bought the property from its owner and did not want to present any documents as they fear for the life of the “Arab” seller. We, the lawyers, as well as the court refused those claims and considered that they don’t have any documents; note that they submitted a sealed envelope to the judge that contained confidential documents as they claim. The court confidentially checked the documents and gave the company the option to give us a copy or withdraw them from the case. The company chose to withdraw the papers and the judge made his evacuation decision.” Deebeh pointed out that the head of “Elad Organization” (David Pierre) was the representative of the foreign company in Israel and he is the head of the Musta’ribeen unit in the Israeli army. It is noteworthy that Al-Khayyat family building in Wadi Hilweh consists of several floors.
