Sentencing a child…extensions of arrest…and releases

The Magistrate judge sentenced the child Haitham Barakat for 5 months of actual imprisonment, a suspended probation of 4 months for three years and a 2500-NIS fine. Lawyer Mohammad Mahmoud explained that his client Barakat was beaten by the wardens last week while detained in Giv’on prison and was injured with several bruises and pains; signs of beating were clear on Barakat during the session. It is noteworthy that Giv’on prison was recently opened for minor prisons and is considered the worst among occupation prisons as it last the most basic necessities of life (food, clothes, cleaning material and blankets). Extensions of arrest… Lawyer Mohammad Mahmoud explained that the Magistrate judge extended the arrest of Laith Husseini, Malek Shweiki, Baker Aweis (arresting while heading to school), Fayez Shahin, Amir Salloum, Suhaib Abu Sa’ed, Mahmoud Abed and Nader Naser until 15/11/2015. The judge also extended the arrest of Nour Eddin Zaghal, Mohammad Naser, Muntaser Salameh and Nader Naser until 16/11/2015, Ibrahim Shweiki until 24/11/2015, Hamzeh Najjar and Islam Najjar until completing the legal procedures against them. The judge also extended the house-arrest imposed on the child Ahmad Abu Khalaf and a session was scheduled for him on 18/11/2015. He also extended the house-arrest imposed on the child Fayez Farhan with allowing him to go to school; a session was scheduled for him on 15/2/2015 (witnesses hearing session). The child Mohammad Abu Nab was presented to the judge and a session was scheduled for him on 2/2/2016; he is not detained. Also, the child Tayseer Natsheh was presented to the District judge and a session was scheduled for him on 29/11/2015 and the child Mohammad Obeid was also presented to the judge and another session was scheduled on 22/11/2015; a session was scheduled for Nadim Obeid on 2/2/2016. The judge convicted Basel Sider and extended his arrest until 2/2/2016. The judge also extended the arrest of Nasri Firawi until 23/11/2015 (conduct officer’s report) and Issa Firawi and Mohammad Nokad until 2/2/2016 (sentencing and conduct officer’s report). Tamer Abu Asab was presented to the judge and a session was scheduled on 24/11/2015. The judge extended the arrest of Ala’ Obeid until 6/12/2015 (sentencing and conduct officer’s report). The judge also decided to release Ibrahim Musleh with a third-party bail but the prosecution appealed the decision. Indictments… The prosecution submitted an indictment against the child Mohammad Ammouri and the judge extended his arrest until 18/11/2015 and an indictment against the child Mohammad Hatem Abulhawa and a session was scheduled for him on 18/11/2016; he is not detained. The prosecution also submitted indictments against Mohammad Jihad Alayan and Mohammad Adnan Obeid and the judge extended their arrest until 16/11/2015.  Isolation from Al-Aqsa Mosque The judge decided to release Naser Ajaj, Ahed Risheq and Hamzeh Ajaj on conditions of isolation from Al-Aqsa Mosque for 45 days and a third party bail of 5 thousand NIS. Release… The judge released the child Ibrahim Abulhawa on conditions of house-arrest, deportation, a 3-thousand NIS bail and a third-party bail of 10 thousand NIS. The child Mohammad Risheq was also released with a 5-thousnad NIS bail and on condition of staying at least 500 meters away from settlers’ houses in the neighborhood of Sheikh Jarrah for 45 days. The judge also decided to release Mohammad Kayed Mahmoud, Mohammad Nayef Alayan, Mahmoud Dirbas, Hamed Abed and Bashar Dari with a 1000-NIS bail, house-arrest for 7 days and a third-party bail of 5 thousand NIS for each. The judge also unconditionally released Mohammad Yaser Abulhawa.
