After challenging the evidence- A decision to release a Jerusalemite young man after accusing him of “planning to carry out an attack”
December 14, 2016

The Magistrate judge decided to release last Wednesday 19-year old Amin Hamed after the lawyer challenged the evidence submitted by the public prosecution in order to arrest him and file an indictment against him.

Lawyer Mohammad Mahmoud explained that the public prosecution submitted last week an indictment against 8 Palestinian young men from Sur Baher and Sheikh Jarrah including charges of “planning to carry out attacks including opening fire towards a military camp for the Israeli forces north of Jerusalem”. According to the indictment, some of the young men were in prison in 2015 on charges of participating in clashes and throwing stones. While in prison, they agreed to form a cell when they get out in order to carry out attacks against occupation forces personnel.

Lawyer Mahmoud added that the session of “challenging the evidence” for his client Amin Hamed was held last week. When checking his file, it was revealed that the young was not in prison with the other young men in that period. This demonstrates the failure of the public prosecution and hiding information to continue detaining Hamed for 10 extra days.

Lawyer Mahmoud added that the prosecution agreed to release his client Amin Gamed on condition of house-arrest until submitting an application to cancel the indictment that was filed against him
